There’s a detention pond at the back of the neighborhood. It fills up during storms, drains slowly, and mostly sits empty. The grass around it gets mowed occasionally. Nobody on the board thinks much about it.

That pond is almost certainly in your HOA’s name on the drainage easement. It has a plat note requiring your HOA to maintain it in perpetuity. It has an outlet structure, a concrete or steel pipe and grate assembly, that controls how fast water leaves after a storm. If that outlet structure fails, or if years of sediment accumulation have reduced the pond’s capacity to the point where it can no longer handle a design storm, your HOA is responsible. Financially, legally, and in the eyes of the downstream property owners whose basements flood when stormwater management fails.

Most HOA boards don’t know any of this until something goes wrong.

How HOAs End Up Owning Stormwater Facilities

When a subdivision is developed in Colorado, the developer is typically required to build stormwater detention facilities as a condition of development approval. These facilities (detention ponds, outlet structures, underground systems, water quality features like bioretention cells) are built to satisfy the municipality’s stormwater requirements and protect downstream properties from increased runoff.

Once the development is complete and the HOA is formed, ownership and maintenance responsibility for those facilities transfers from the developer to the HOA. This transfer happens through plat notes, drainage easements, and HOA governing documents. It’s usually buried in the legal paperwork that nobody on the board has read. But it’s binding.

What the developer doesn’t typically do is hand the HOA a maintenance manual, an inspection schedule, or a capital reserve estimate for the eventual replacement of those facilities. They built it and walked away. Your HOA inherited an asset and an obligation with no instruction manual.

What the Obligation Actually Requires

The specific maintenance requirements for your facilities depend on the municipality where the development is located. Most Front Range municipalities with MS4 permits have post-construction stormwater management programs that include requirements for HOA-maintained facilities. These typically include:

Annual or biannual inspections. Many municipalities require periodic inspections of detention and water quality facilities by a qualified professional. The inspection report documents facility condition, identifies maintenance needs, and provides the municipality with evidence that the responsible party is maintaining the system.

Specific maintenance activities. Sediment removal when the pond loses a certain percentage of its storage capacity. Outlet structure inspection and cleaning. Vegetation management. Erosion repair. The maintenance obligations are usually spelled out in a Drainage Report or Drainage Operations and Maintenance Manual that was submitted to the municipality during the development approval process. That document is a public record, and it governs what your HOA is required to do.

Documentation. Some municipalities require HOAs to submit inspection records or maintenance logs. Even where it’s not required, maintaining records is critical for protecting the board from liability claims.

What Happens When Maintenance Is Neglected

Stormwater facility failures are slow-moving problems that become sudden crises. A detention pond that hasn’t been inspected in a decade may have lost 30 percent of its storage capacity to sediment accumulation. An outlet structure with a plugged trash rack during a heavy storm can overtop a berm, erode an embankment, and cause downstream flooding in a matter of hours.

When that flooding damages downstream properties, the affected homeowners have a cause of action against the party responsible for maintaining the facility. That party is your HOA, and the liability flows to the board members who were responsible for the maintenance program.

I’ve seen the aftermath of this. Remediation costs for a failed detention pond embankment run well into six figures. Add legal fees, potential judgments, and the cost of emergency repairs done under pressure rather than planned maintenance conditions, and you’re looking at an assessment that rattles the entire community.

None of that is inevitable. It’s the consequence of not having a program.

What a Basic Program Looks Like

Running an effective HOA stormwater maintenance program doesn’t require a dedicated engineer on staff. It requires three things: knowing what you own, inspecting it regularly, and budgeting for long-term costs.

Asset inventory. Know exactly which facilities your HOA owns and maintains. Get a map. Get the original drainage report from the municipality if you don’t have it. Document the location, size, and condition of each asset. This is the foundation everything else builds on. You can’t maintain what you haven’t inventoried.

Regular inspections. At minimum, inspect each facility annually. For older facilities or facilities that show signs of wear, inspect more frequently. Document every inspection with photos, condition ratings, and a record of any maintenance performed. That paper trail is your protection when questions arise about whether the board fulfilled its duty.

Reserve fund planning. Stormwater facilities have finite lifespans. Outlet structures corrode. Pond liners crack. Underground detention systems need eventual replacement. None of these are cheap surprises. They’re predictable capital expenses that your HOA can plan for if you know what you have and when it will reach the end of its useful life. A 20-year capital forecast, updated as inspections are recorded, turns a potential crisis into a line item in your reserve study.
